Thebest option, which would bring the best results, is that Carl canrevise their contract with Monitor to reduce their costs if productsare not delivered as ordered on time so that they can have the timeand money to buy from other companies.

Itwould be the best choice because the contract would incorporate allthe risks that Acacia may face, and it neutralizes all the adverseeffects that Monitor would have caused. When products are notdelivered on time by Monitor, it means that Acacia is inconveniencedbecause it`s not given a chance to get more resources as well as themoney required to purchase the product from other companies.

Carlgoing with the higher priced company to show Monitor that Acacia hasother options such as dropping Monitor, as a supplier, would not beadvisable. This is because it would damage relations with Monitor(Hart, 2013). That would also have an impact on the commodity supplymanager`s purchases from Monitor.

Carltalking to Monitor and explaining the situation and asking Monitorhow they can resolve the matter, or sending someone to work withMonitor to aid them to settle their problems can not fully changethings for the better since nothing will be put into a bindingcontract. It is evident that the first choice would be the best.

The Clements v. State case presents a summary of theinformation that arises from the appeal that the appellant made inresponse to the ruling that the trial judge made. Clements had beenaccused by his ex-wife, Jennifer of stalking him after he had engagedin a number of threatening activities. Nathan was convicted ofstalking his wife, and the trial judge decided that he was guilty andsentenced him to 12 months probation. Instead, he appealed the trialciting that the statute was unconstitutionally vague.

The statute had three elements that considered what stalkingentailed. First, it showed that if the person decides to follow aperson or engage in threatening activities against another person onvarious occasions that are more than once then he or she might beconsidered as a stalker (Englebrecht &amp Reyns, 2011). If theactivities of the victim cause harm or fear among the family membersor even possession, then that is stalking. Lastly, it showed that ifthe victim had a reasonable cause that showed any need to be in fearthen that is a crime.

The clause was not unconstitutionally vague since it aligned with allthe issues that Clement had committed all along. His weak defensethat he did not follow her more than once or his acts were notthreatening or even did not harm Jennifer were just illogical since anumber of witnesses had monitored what he did (Fox et al., 2011). Heeven portrayed characteristics of a person that was obsessive andcontrolling, and he was clearly guilty.

The evidence presented was clearly sufficient since his actionsshowed intention and it was not accidental. Apart from that, a numberof testimonies from the witnesses strengthened the case and showedhow wrong Clement was (Catalano, 2012). Instead, his claim that hedid not know he was a threat to his ex-wife was just vague. All inall, the statute clearly proved that he was a stalker even if hetried to refute such claims.

Procurement needs communication that helps a firm to maintain therelationship they might have with the sellers. On the other hand,budgeted cost management might introduce certain changes that willinterfere with the relationships and the communication too. In somecases, one might need to adjust the suppliers or even the costs so asto maximize the profits. More importantly, in order to save therelationships, there will be the need to urge the suppliers toconduct research and development that will add more modifications andimprove the products to make them more competitive.

The theory of perfect competition is created in a way that thesellers are able to share the gains equally, and none of them can getmore revenue at the expense of the sellers. It allows both the publicand sellers to gain as well. A firm will still make a margin since ittakes its price from the industry hence, the concept of a pricetaker that is used in perfect competition. In the end, none of thecompetitors can offer higher or lower prices at the expense of theother firms in the industry.

It is more likely to be out-competed since the other firms areoffering the same product at a much lower cost. The firm needs toimprove the cost-price ratio to maximize the profits. For instance, the supplier should makeadvanced modifications to the product through intensiveresearch and development. The changes will improve the quality andmake the customers pay more. It will also maintain the symbioticrelationship since the problem will be solved amicably.

The cost management process will provide solutions that will improvethe number of sales. For instance, the firm might decide torenegotiate the prices that the supplier is offering using targetcost. If that fails, one can still purchase the same raw materialsdirectly and send them to the supplier before they reach the firmmaking it cheaper instead. In this case, the outcome is reducing thecosts and maximizing the sales to increase the profits that the firmwill get as well.
